1. OCCUPANCY. Only the following individuals may occupy the premises, and should any other persons occupy the premises without the prior written consent of the Lessor, it shall be considered a material default of this lease.

2. TERM. Lessee leases the premises from Lessor as a month to month tenant. Lessee shall be a tenant from month to month if Lessee continues in possession after the end of this Lease, and if the continuation of possession is with Lessor’s consent. As a month to month tenant, Lessee’s rent shall be such amount as Lessor may lawfully establish, and Lessee shall be subject to all provisions of this lease that may be applicable and consistent with a month to month tenancy.

3. NOTICE OF INTENTION TO VACATE OR RENEW. As a month to month tenancy, either party may terminate this lease AT ANY TIME during the month upon proper delivery of thirty days advance written notice. Termination of this Lease shall take place thirty days after receipt of written Notice to Terminate or any other form of service permitted by law. Notwithstanding anything in this lease to the contrary, Lessor shall not be obligated to enter into a new lease or to agree to a continuation of possession on a month to month tenancy. Although the lease may be terminated at any time during the month a Notice to Terminate received after the 2nd day after monthly due date will obligate Lessee to an additional month’s tenancy and rental payment.

4. RENT. During the term of this Lease, Lessee shall pay $___________ rent per month in advance on the same day of each month as the Lease Date commencing with the commencement date of this lease. The prepayment of rent does NOT modify any of the conditions of this Lease and the term shall remain month to month. There is no prorating of rent.

5. LATE CHARGE. Lessee shall pay a late charge of Fifty dollars ($50.00) if rent is not paid by the expiration date of the previous term. A partial payment of rent shall NOT prevent late charges from accruing. Lessor may, at its option, apply monthly rental payments received from Lessee first to unpaid late charges and/or returned check charges, and the balance to lot rent. A separate “Rent Payment – Late Fee – Returned Check Policy” is incorporated by reference herein.

6. RETURNED CHECK CHARGE. Lessee shall pay a returned check (“NSF”) charge of Fifty Dollars and No/100 ($50.00) for each returned check, plus applicable late charges as per paragraph 5 herein. A check tendered by Lessee in payment of rent and/or charges shall NOT constitute rental payment if the bank for any reason returns the check. Lessor may require all payments of rent and other charges to be by cashier’s check or money order if Lessee has more than ONE check returned “NSF” in any twelve month period.

7. SECURITY DEPOSIT. At the time this lease is signed, Lessee will deposit $___________ with Lessor as security deposit for home and furnishings. Upon termination of this lease, the security deposit will be applied to any damages and/or the replacement of missing home furnishings first, the balance, if any, to be applied towards any past due rents or late charges . LESSEE SHALL NOT APPLY OR DEDUCT ANY PORTION OF THE SECURITY DEPOSIT FROM LAST MONTH’S RENT OR USE OR APPLY SUCH SECURITY DEPOSIT AT ANY TIME IN LIEU OF PAYMENT OF RENT. The balance of the security deposit shall be refunded to Lessee, without interest, within thirty days after termination of this lease and delivery and possession of the leased premises to Lessor. Lessee must provide Lessor with a correct forwarding address to which the security deposits refund, if any, and accompanying statement should be sent.

8. USE OF PREMISES. Lessee is to occupy the premises as a private dwelling and for no other purpose whatsoever. Lessee may not operate a business from their mobile home. Lessee shall use and occupy the premises in a clean and wholesome manner, not rearrange furniture and be in compliance with all applicable governmental requirements and the park Rules and Regulations promulgated by Lessor relating to such occupancy. Guests are to be accompanied by Lessee at all times when on the premises. LESSEE SHALL NOT ENGAGE IN ANY CONDUCT OR ACTIVITY OR ALLOW ANY PERSON OR ANIMAL ON THE PREMISES THAT WILL DISTURB THE QUIET AND PEACEFUL ENJOYMENT OF THE PREMISES BY OTHER RESIDENTS OF THE MOBILE HOME PARK.

9. FACILITIES AND UTILITIES. Water, sewage, trash, wifi, mowing, weed-eating, electricity and propane, are furnished by Lessor as part of this lease.

10. Lessor reserves the right to shut of all utilities when found to be necessary, and Lessee agrees to release Lessor from liability of and/or any damage caused therefrom. Any damage or stoppage to the sewer line before it reaches the septic tank shall be repaired promptly at the Lessee’s expense. Sewer lines must be kept tight and free from leaks. Running of water in the wintertime to keep pipes from freezing will not be allowed.

11. An electric pump controls the water well. In the event that electricity goes out for any reason, water will not be available or provided by Lessor to Lessee until the electricity is restored. Lessee agrees to release Lessor from any liability of and/or any damage caused therefrom.

12. ASSIGNMENT AND SUBLETTING. Lessee shall not sublet the premises or any part thereof, or assign this lease without Lessor’s prior written consent. Tenants subletting are bound by the terms of this agreement.

13. RULES AND REGULATIONS. Lessee acknowledges receipt of a copy of the current park Rules and Regulations, which are incorporated in this Lease as additional terms and covenants. Lessee and his guests and invitees shall comply with all park rules and the entire city, county, state and federal laws and/or regulations. ANY VIOLATION OF THE PARK RULES OR APPLICABLE LAWS OR REGULATIONS SHALL RENDER THIS LEASE SUBJECT TO TERMINATION BY LESSOR. Lessor reserves the right to add to or amend the Park Rules (which shall amend this lease accordingly) and Lessee shall be bound by the amended rules upon receipt of a copy thereof from Lessor or the posting of the revisions in the park office.

14. PETS. No animals or pets of any kind shall be kept inside the home, or on the premises.

15. SMOKING: NO SMOKING IS ALLOWED IN MOBILE HOME.

16. CONDITIONS OF PREMISES. Lessee agrees that no representation as to condition or repair of the premises and no promise to alter, repair or improve the premises has been made except as contained in this Lease. During the term of this Lease, Lessee shall keep the premises in good repair and at the expiration thereof, yield and deliver up the same in like condition as when taken, reasonable wear and tear accepted.

17. ALTERATION OR IMPROVEMENTS. Lessee shall make no alterations, decorations, additions or improvements in or to the premises or install any fixture or equipment, including a fence, without Lessor’s prior written consent, and then only by contractors and mechanics first approved in writing by Lessor. Any such installation by Lessee without Lessor’s prior written consent may be removed by Lessor, and Lessee shall pay Lessor’s cost of removal on the next monthly rental due date. In the event that Lessor’s written consent is received, Lessee shall cause such work to be done at such times and in such a manner as Lessor shall designate in writing, and Lessee shall pay for the same in a prompt manner. Any mechanic’s lien filed against the premises or the mobile home park for work claimed to have been done for, or materials claimed to have been furnished to Lessee within 7 days thereafter. Lessor shall have the right, but not the obligation, to pay or discharge any such mechanic’s lien. If Lessor should elect to exercise this right, Lessee shall pay Lessor the amount so expended on the next ensuing monthly rental due date.

18. RESERVED RIGHT TO ENTER PREMISES. Lessor reserves the right as may be allowed by law, to inspect, repair, alter or to add to the premises at all reasonable times, and to exhibit the premises to prospective residents, or purchasers or others as may be allowed by law.

19. DAMAGE BY FIRE OR OTHER CASUALTY. If the premises are partially damaged by fire, tornado, flood, or other casualty, but can be restored to tenantable condition, Lessor shall repair the premises with reasonable dispatch.

20. PERSONAL INJURIES DUE TO FIRE AND OTHER CASUALTY. The Lessor will not be responsible for injuries to persons or for property lost by park tenants, invitees or guests, from fire, windstorm, tornado, flood, or any other casualty.

21. LESSOR’S NON-LIABILITY. Lessor shall not be responsible or liable to Lessee for any loss or damage that may be occasioned by or through the acts or omissions of persons occupying adjoining premises or any part of the premises adjacent to or connected with the leased premises. IN ADDITION, LESSOR SHALL NOT BE LIABLE FOR ANY DAMAGE OR INJURY TO ANY PERSON OR PROPERTY WHICH OCCURS ON THE PREMISES RESULTING FROM THE USE OF THE LAKE OR OTHER RECREATIONAL FACILITIES OF LESSOR UNLESS SUCH DAMAGE SHALL BE CAUSED BY THE NEGLIGENCE OF LESSOR.

22. STORM OR WEATHER RISKS. LESSOR SHALL NOT BE LIABLE FOR ANY DAMAGE OR LOSS OCCASIONED BY STORMS OR OTHER WEATHER EVENTS. THIS DISCLAIMER INCLUDES DAMAGE FROM DOWNED TREES OR TREE LIMBS AND/OR LACK OF UTILITIES DUE TO WEATHER EVENTS. LESSEE ASSUMES ALL RISKS ASSOCIATED WITH THE PLACING OF A MOBILE HOME OR OTHER PROPERTY NEAR A TREE.

23. ABANDONMENT OF PERSONAL PROPERTY. If Lessee abandons the mobile home, leaving personal property, the expenses for removal of personal property will be assessed to the Lessee, at a fee of not less than $500.00 and not more than $3,000.00 for the removal and/or storage of the said personal property. Lessor may dispose of any ascertainable or apparent value without any duty of accounting to Lessee. Lessee agrees to pay a storage fee of $25.00 per day for any personal property stored by Lessor. Such storage charges shall be due on demand and Lessor shall have a lien on the property stored to secure payment of all storage charges and may foreclose such lien pursuant to Section 91 of Title 42 of the Oklahoma Statutes.

24. EMINENT DOMAIN. If, during the term of this lease, proceedings shall be instituted under the power of eminent domain which shall result in an eviction, total or partial, of Lessee, at the time the trial of such proceedings shall commence, this lease shall be void, and the term above shall cease and terminate.

25. GUESTS. Residents of this park shall be responsible for all guests and their conduct while in the park.

26. VEHICLES. Cars are to be parked only on the driveways. No Parking whatsoever anywhere other than driveway. Automobiles not being used daily must be removed from the park. Residents who park other than on the driveway will be subject to a fine of $100.00.

27. HUNTING. Hunting is not allowed.

28. LAKE MAINTENANCE. The Lessee or any of Lessee’s guests shall throw no foreign matter into the lake, and Lessee shall be responsible for enforcement of this rule and regulation.

29. SIGNS. The Lessee and his guests shall respect any signs placed by the Lessor. Any signs containing rules and regulations shall be respected and abided by as part of this lease.

30. SPEED LIMITS AND OFF-ROAD VEHICLES. Only the roads designed shall be used. The speed limit is 10 M.P.H. (ten miles per hour). If mini-bikes or motor bikes are brought on the premises, such shall be regulated with minimum speeds posted by the Lessor and shall not have the full and complete use of all the lake area, but shall only be ridden on the roads designed by the Lessor.

31. LAKE GUESTS. Guests are limited to five adults at one time and three visits per year, and guests are to be accompanied by Lessee at all times when on the premises.

32. SAFETY REGULATIONS. Lessee shall abide by all safety regulations, especially with respect to boating, swimming, diving, or water skiing, or in any use of water equipment.

33. NO guests shall be permitted, including Lessee and members of Lessee’s family, to water ski or to boat without the use of life jackets. All boats shall be equipped with sufficient safety devices, including life jackets.

NO operating any vehicle or boat in or on the lake area while under the influence.

WHEN more than one boat is on the lake, all boats are to travel in a counterclockwise motion.

JET skis are to abide by the same rules as boats.

NO swimming shore to shore.

NO rafting across necks while boats are running.

LESSEE SHALL ALSO ABIDE BY ANY OTHER SAFETY REGULATIONS THAT MAY BE POSTED.

34. PROTECTION OF LAKE. The Lessee or his guests shall not do anything to the detriment of the lake, molesting any water gates or anything that would affect the level of the lake, this being entirely the responsibility of the Lessor or the Soil Conservation Office having supervision of said lake.

35. PARKING. The property east of the cabins is not a parking lot. Only cars or vehicles used for the purpose of unloading and loading watercraft may be parked on this area and only while such watercraft is in use. No parking around the swimming area. NO PARKING ON GRASS.

36. SNOW SLEDDING. No snow sledding on lake premises.

37. DEFAULT. If Lessee should default under this lease, or if Lessee’s statements in the rental application are incorrect or false, Lessor shall have the right, among others, to terminate this Lease and to repossess the premises and cause Lessee to vacate the premises in the manner provided by Law. If this should occur, Lessee shall pay Lessor the expenses incurred in obtaining possession of the premises and all other damages sustained by Lessor to the extent permitted by law.

38. SEVERABILITY. If any provision of this lease should be or become invalid, such invalidity shall not in any way affect any of the other provisions of this lease that shall continue to remain in full force and effect.

39. WAIVER. If Lessor should waive any provisions of this lease, it shall not be construed as a waiver of a further breach of such provision.

40. MODIFICATIONS. No modifications of this lease shall be binding unless in writing, signed by Lessee and by Lessor or an authorized agent of Lessor.

41. LIABILITY OF MORE THAN ONE LESSEE. In the event that this lease should be signed as Lessee by more than one person, then the liability of the persons signing shall be joint and several.

42. BINDING EFFECT. The provisions of this lease shall be binding upon and shall be for the benefit of Lessor and Lessee and their respective successors in interest.

43. INTERPRETATION. This lease shall be construed according to the laws of the State of Oklahoma.

44. TRASH DISPOSAL. DUMPSTERS ARE FOR HOUSEHOLD TRASH ONLY!. Tenants are to place HOUSEHOLD trash in the dumpster and close the dumpster door when finished. The tenant is responsible to dispose of any items other than household trash in another manner. This includes but is not limited to, hazardous waste, furniture, appliances, tires, auto parts, etc. Please see attached OEMA Guidelines. Any tenant not abiding by these rules will be subject to a fine of not less than $100.00 per offense or the cost incurred by management to have these items removed, whichever is greater.
